The Institute of International Law and International Relations at the University of Graz (IILIR, department Prof. Schmalenbach) signed a cooperation agreement with the International Criminal Court (ICC) in 2008. The IILIR committed its cooperation for the further elaboration of three ICC Legal Tools: the Elements Commentary, Publicists and National Cases Involving Core International Crimes.

  • The Elements Commentary is a doctrinal work on substantive law applicable before the ICC. It comments on each element of the crimes and legal requirement of the modes of liability in the ICC Statute drawing upon all sources of international criminal law.

    The work on the Elements Commentary comprises two major areas. Regarding substance, the IILIR will update and expand the contents of the Elements Commentary. Relevant sources of law will be identified, analyzed and incorporated into the Elements Commentary. Major emphasis will be given in this regard to the jurisprudence of international(ized) courts and tribunals. From a technical point of view, the IILIR will increase the Elements Commentary’s inter-connectivity and ease of use, by automatically linking references to source documents.

  • With regard to National Cases on Core International Crimes, the IILIR will collect and include the most relevant decisions concerning genocide, crimes against humanity and war crimes, issued by domestic courts and tribunals in the following two regions, German speaking countries (Austria, Germany, Switzerland, Liechtenstein) and Western Balkan states (Albania, Bosnia and Herzegovina, Croatia, Macedonia, Montenegro, Serbia), in the respective ICC Legal Tools database.
  • The ICC Legal Tool Publicists, contains articles and opinions by prominent scholars on international criminal law and related fields. The IILIR will include selected scholarly articles by Austrian, German and Swiss scholars relevant to the law applicable before the ICC to the ICC Legal Tools database.
